  • Petty Offenses - There are two types of petty offenses in the state of Colorado.

    • Class 1 petty offenses include trespassing, public indecency, and gambling, and penalties can include fines up to $500 and up to six months in jail.

    • Class 2 petty offenses can also include fines and jail time but are sentenced according to charges. Examples of class 2 petty offenses include theft, littering, and pollution violations.

  • Misdemeanors - Misdemeanor charges involve more serious criminal behaviors, and are most often handled in county court. There are three classes of misdemeanors in Colorado.

    • Class 1 misdemeanors are the most serious misdemeanor charges. They can include a variety of crimes including unlawful sexual contact, assault, and indecent exposure. Class 1 misdemeanors can be accompanied by fines of $500 to $5,000 and between six and 18 months of jail time.

    • Class 2 misdemeanors include illegal concealed carry of a weapon, manufacturing, selling, or delivering drug paraphernalia, and theft of property valued between $100 and $500. Penalties include between three and 12 months of jail time and fines from $250 to $1,000.

    • Class 3 misdemeanors are the least serious misdemeanor charges and can include prostitution or soliciting of a prostitute, third-degree criminal trespass, and theft of property valued at less than $100. Penalties for class 3 misdemeanors can include fines from $50 to $750 and up to six months in jail.

  • Felonies - Felony crimes in Colorado are considered the most serious. There are six levels of felony crimes, which have the highest level of punishment including large fines and prison sentences.

    • Class 1 felonies are the most serious type of felony. First-degree kidnapping, first-degree murder, and treason are examples of class 1 felonies and can be punishable by life in prison or the death penalty.

    • Class 2 felonies include human trafficking, murder, sexual assault, and racketeering. Penalties include eight to 24 years in prison and fines from $5,000 to $1,000,000.

    • Class 3 felonies can include first or second-degree burglary, some types of sexual assault, arson, and vehicular homicide. Class 3 felonies can include fines up to $750,000 and four to 12 years in prison.

    • Class 4 felonies can include identity theft, robbery, manslaughter, and sexual assault and can be penalized by fines of $2,000 to $500,000 and two to six years in prison.

    • Class 5 felonies can include criminal actions like stalking, first-degree assault, or failure to register as a sex offender. Class 5 felonies are punishable by fines between $1,000 and $100,000 and up to three years in prison.

    • Class 6 felonies are the least serious type of felony in Douglas County, and Colorado as a whole. Class 6 felonies can include criminal behaviors including possession of a weapon on school property, possession of methamphetamine, or impersonating a peace officer. Penalties can include fines up to $100,000 and up to 18 months in prison.
